Release of Liability – Terms and Conditions
1. Acceptance of Terms
By purchasing, receiving, installing, or using any products manufactured or supplied by Hulse Engineering, the customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
2. Intended Use
All products are intended solely for their specified applications. Any modification, misuse, improper installation, racing, off-road use (unless specifically designed for such use), or use outside the manufacturer's recommendations is at the sole risk of the customer.
All products are sold for off-road, competition, or closed-course use only and are not intended for highway or public road use.
3. Professional Installation
Unless otherwise stated, products should be installed by qualified automotive technicians. Failure to properly install, inspect, or maintain the product may result in equipment failure, property damage, serious injury, or death.
4. Assumption of Risk
The purchaser and user acknowledge that automotive components inherently involve risks. By purchasing or using the product, the purchaser voluntarily assumes all risks associated with installation, operation, maintenance, and use.
5. Release of Liability
To the fullest extent permitted by applicable law, Hulse Engineering, its owners, officers, employees, affiliates, distributors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:
- Personal injury or death.
- Property damage.
- Vehicle damage.
- Loss of income or business.
- Towing, storage, or repair costs.
- Any other economic or consequential losses.
This limitation applies regardless of whether liability is alleged under contract, negligence, strict liability, product liability, warranty, or any other legal theory.
6. Warranty Disclaimer
Except for any written limited warranty expressly provided by Hulse Engineering, all products are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, Hulse Engineering disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Damages
If Hulse Engineering is found legally liable despite these Terms, the customer's exclusive remedy shall be limited to the original purchase price of the product.
8. Inspection Requirement
Customers must inspect all products upon receipt and before installation. Installation or use constitutes acceptance of the product's condition.
9. Compliance with Laws
The customer is solely responsible for ensuring compliance with all applicable federal, state, provincial, and local laws regarding vehicle modifications, emissions, safety regulations, and inspections. Products are not certified or approved for use on public highways or roadways.
10. Indemnification
The purchaser agrees to defend, indemnify, and hold harmless Hulse Engineering from any claims, damages, liabilities, costs, or attorney's fees arising from the installation, modification, resale, or use of the product.
11. No Guarantee of Performance
Performance claims, horsepower estimates, fuel economy improvements, or other results are estimates only and are not guaranteed.
12. Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
Any disputes arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Mesa County, Colorado, and the customer consents to the personal jurisdiction of such courts.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between the parties regarding the purchase and use of the products and supersede any prior oral or written agreements.
15. Customer Acknowledgment
By purchasing, installing, or using the product, the customer acknowledges that they understand these Terms and voluntarily agree to be bound by them.
